1) Introduction and contact details of the controller

1.1 We are pleased that you are visiting our website and thank you for your interest. In the following, we inform you about the handling of your personal data when using our website. Personal data is any data with which you can be personally identified.

The controller responsible for the processing of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

2) Data collection when visiting our website

2.1 When merely using our website for informational purposes, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to the server ("server log files"). When you access our website, we collect the following data which is technically necessary for us to display the website to you:

  • Our visited website
  • Date and time at the time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used
  • IP address used (where applicable: in anonymised form)

Processing takes place in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or otherwise used. However, we reserve the right to subsequently check the server log files if there are concrete indications of unlawful use.

2.2 This website uses SSL or TLS encryption for security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or enquiries sent to us). You can recognise an encrypted connection by the string "https://" and the lock symbol in your browser line.

3) Hosting & Content Delivery Network

For hosting our website we use Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. Processing takes place exclusively in data centres within the European Union (Germany).

All data collected on our website is processed on these servers.

We have concluded a data processing agreement under Art. 28 GDPR with the provider, which ensures the protection of our site visitors' data and prohibits unauthorised disclosure to third parties.

4) Cookies

To make visiting our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your device. Some of these cookies are automatically deleted after closing the browser ("session cookies"), some of these cookies remain on your device for longer and enable page settings to be saved ("persistent cookies"). In the latter case, you can find the storage period in the overview of your web browser's cookie settings.

If personal data is also processed by individual cookies used by us, the processing takes place in accordance with Art. 6(1)(b) GDPR either for the performance of the contract, in accordance with Art. 6(1)(a) GDPR in the event of consent being given, or in accordance with Art. 6(1)(f) GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the site visit.

You can set your browser so that you are informed about the setting of cookies and can decide individually about their acceptance or exclude the acceptance of cookies for specific cases or generally.

Please note that the functionality of our website may be restricted if cookies are not accepted.

5) Contact

Within the scope of contact with us (e.g. via contact form or e-mail), personal data is processed exclusively for the purpose of processing and responding to your request and only to the extent necessary for this purpose.

The legal basis for the processing of this data is our legitimate interest in responding to your request in accordance with Art. 6(1)(f) GDPR. If your contact is aimed at a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR. Your data will be deleted when it can be inferred from the circumstances that the matter in question has been finally clarified and provided that no statutory retention obligations oppose this.

6) Data processing when opening a customer account

In accordance with Art. 6(1)(b) GDPR, personal data will continue to be collected and processed to the extent required if you provide it to us when opening a customer account. Which data is required for account opening can be found in the input mask of the corresponding form on our website.

Deletion of your customer account is possible at any time and can be made by a message to the above-mentioned address of the controller. After deletion of your customer account, your data will be deleted, provided that all contracts concluded via it have been fully processed, no statutory retention periods oppose this and we have no legitimate interest in continued storage.

7) Data processing for order processing

7.1 Insofar as necessary for the execution of the contract for delivery and payment purposes, the personal data collected by us will be passed on in accordance with Art. 6(1)(b) GDPR to the commissioned transport company and the commissioned credit institution.

If we owe you updates for goods with digital elements or for digital products on the basis of a corresponding contract, we process the contact data (name, address, e-mail address) transmitted by you when ordering in order to personally inform you about pending updates within the statutory period via suitable communication channels (e.g. by post or e-mail) within the scope of our statutory information obligations in accordance with Art. 6(1)(c) GDPR. Your contact data will be used strictly for the purpose of notifications about updates owed by us and processed by us only to the extent necessary for the respective information.

For the processing of your order, we further cooperate with the following service provider(s) who support us in whole or in part in the execution of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

7.2 Use of payment service providers

- Stripe

One or more online payment methods from the following provider are available on this website: Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland

When selecting a payment method from the provider for which you make an advance payment (e.g. credit card payment), your payment data provided during the order process (including name, address, bank and payment card information, currency and transaction number) as well as information about the content of your order will be passed on to this provider in accordance with Art. 6(1)(b) GDPR. The transfer of your data takes place in this case exclusively for the purpose of payment processing with the provider and only to the extent that this is necessary for this.

When selecting a payment method where the provider makes an advance payment (e.g. purchase on account or installment purchase or direct debit), you will also be asked during the ordering process to provide certain personal data (first and last name, street, house number, postal code, city, date of birth, e-mail address, telephone number, and where applicable, data for an alternative means of payment).

In order to safeguard our legitimate interest in determining the solvency of our customers, this data is forwarded by us to the provider for the purpose of a credit check in accordance with Art. 6(1)(f) GDPR. The provider checks on the basis of the personal data provided by you as well as other data (such as shopping cart, invoice amount, order history, payment experience) whether the payment method selected by you can be granted with regard to payment and/or default risks.

The credit report may contain probability values (so-called score values). Where score values are included in the result of the credit report, they are based on a scientifically recognised mathematical-statistical procedure. Among other things, address data is included in the calculation of the score values, but not exclusively.

You may object to this processing of your data at any time by sending a message to us or to the provider. However, the provider may still be entitled to process your personal data if this is necessary for contractual payment processing.

8) Site functionalities

Supabase

On our website, we use the service of the following provider to verify login attempts for protected site areas: Supabase, Inc., 548 Market St, San Francisco, CA 94104, USA.

Exclusively on the basis of our legitimate interest in safeguarding the structural and data security of our website, your login data (e-mail, username and password) is transmitted to the provider for authentication in accordance with Art. 6(1)(f) GDPR in order to decide on the release of the login attempt.

We have concluded a data processing agreement with the provider that protects the data of our site visitors and prohibits disclosure to third parties.

For the transfer of data to the USA, the provider relies on the European Commission's standard contractual clauses, which are intended to ensure compliance with the European level of data protection.

Data processing by Supabase takes place on cloud infrastructure operated by Amazon Web Services, Inc. (Frankfurt region, Germany) as a technical sub-processor. The standard contractual clauses referenced above and the data processing agreement with Supabase apply equally to this processing.

Resend (Transactional Email Delivery)

For sending transactional emails (e.g. registration confirmation, password reset, automated status notifications) we use the service Resend (Resend, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA).

For each email sent, at minimum the recipient's email address and the message contents are transmitted to the provider. The legal basis for processing is Art. 6(1)(b) GDPR (contract performance) and Art. 6(1)(f) GDPR (legitimate interest in reliable delivery of service-related emails). No newsletters or promotional communications are sent via this channel.

Resend uses Amazon Web Services, Inc. (Amazon Simple Email Service, USA) as a technical sub-processor for email delivery. For data transfer to the USA, Resend relies on the European Commission's standard contractual clauses.

We have concluded a data processing agreement under Art. 28 GDPR with Resend.

9) Rights of the data subject

9.1 Applicable data protection law grants you the following data subject rights (rights to information and intervention) vis-à-vis us as the controller with regard to the processing of your personal data, whereby reference is made to the stated legal basis for the respective exercise requirements:

  • Right of access under Art. 15 GDPR;
  • Right to rectification under Art. 16 GDPR;
  • Right to erasure under Art. 17 GDPR;
  • Right to restriction of processing under Art. 18 GDPR;
  • Right to notification under Art. 19 GDPR;
  • Right to data portability under Art. 20 GDPR;
  • Right to withdraw consent given under Art. 7(3) GDPR;
  • Right to lodge a complaint under Art. 77 GDPR.

9.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST IN THE CONTEXT OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION.

IF YOU MAKE USE OF YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED. FURTHER PROCESSING REMAINS RESERVED, HOWEVER, IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FUNDAMENTAL FREEDOMS, OR IF THE PROCESSING SERVES THE ASSERTION, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU MAKE USE OF YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

10) Duration of storage of personal data

The duration of the storage of personal data is measured on the basis of the respective legal basis, the purpose of processing and - if relevant - additionally on the basis of the respective statutory retention period (e.g. commercial and tax law retention periods).

When processing personal data on the basis of explicit consent in accordance with Art. 6(1)(a) GDPR, the data concerned is stored until you withdraw your consent.

If there are statutory retention periods for data that is processed in the context of legal transactions or quasi-legal obligations on the basis of Art. 6(1)(b) GDPR, this data is routinely deleted after expiry of the retention periods, provided that it is no longer necessary for the performance of the contract or the initiation of the contract and/or we have no legitimate interest in continued storage.

When processing personal data on the basis of Art. 6(1)(f) GDPR, this data is stored until you exercise your right to object under Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6(1)(f) GDPR, this data is stored until you exercise your right to object under Art. 21(2) GDPR.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
